私たちは、長い間「日本は豊かな国だ」と考えてきました。
戦後復興を経て、日本は世界第2位の経済大国となり、バブルの時代には、土地も株も企業も大きく膨らみました。けれど、その豊かさは永遠ではありませんでした。バブル崩壊、ソビエト崩壊後の市場競争、就職氷河期、リーマンショック、人口減少、少子化、ひきこもり、孤立死、餓死事件。日本社会は、少しずつ「経済成長だけでは人を守れない」という現実に直面してきました。
その中心にあるのが、日本国憲法第25条です。
憲法25条は、すべての人に「健康で文化的な最低限度の生活」を保障するという、戦後日本の大きな約束です。そして生活保護法は、その約束を現実の生活に届けるための制度です。
しかし、生活保護は長い間、誤解や偏見にもさらされてきました。困っている人を助ける制度であるはずなのに、「自己責任」「不正受給」「働けるはずだ」という言葉が先に立ち、助けを求める人が窓口の前で立ち止まってしまうことがありました。
その結果、餓死事件や孤立死が起きました。憲法があり、生活保護法がありながら、人が食べられずに亡くなる。これは、制度が存在しているだけでは命に届かないことを示しています。
一方で、生活保護をめぐる裁判は、制度の意味を少しずつ広げてきました。
学資保険をめぐる裁判では、生活保護を受けていても、子どもの進学や将来を考えることは認められるべきだという考え方が示されました。車の保有をめぐる裁判では、地方では車がぜいたく品ではなく、通院、買い物、仕事、家族生活を支える生活手段であることが問われました。生活保護基準引下げをめぐる裁判では、行政が決める最低生活基準にも、合理的な根拠が必要だと問われました。
つまり、生活保護を受ける人は、単に「管理される人」ではありません。
子どもの未来を考え、地域を移動し、病院へ行き、働く可能性を探し、生活を立て直そうとする一人の人格です。
この視点は、公害の歴史ともつながります。
水俣病は、経済成長が地域の自然、身体、家族、暮らしを傷つけた事件でした。公害から環境政策へと制度は進みましたが、失われた健康や地域の信頼は簡単には戻りません。公害とは、経済の外にある問題ではありません。企業利益や成長の裏側で、被害の費用を住民と地域と未来世代に押しつけた問題です。
だから、経済と財政を考えるとき、私たちは単に「税収を増やす」「支出を減らす」だけでは足りません。
消費税と法人税のバランス、国際競争、社会保障財源、地域経済、環境、福祉を一緒に考える必要があります。消費税は広く負担を求める税ですが、低所得の人ほど重く感じやすい税でもあります。一方で法人税を下げ続ければ、社会保障や地域の財源は弱くなります。国際競争の中でも、企業、生活者、地域がどう負担を分かち合うのかを考えなければなりません。
生活が苦しくなると、社会はしばしば怒りの矛先を弱い人に向けます。外国人、生活保護利用者、障害者、高齢者、ひとり親、少数者が攻撃されることがあります。これがレイシズムや排外主義の台頭です。
しかし、本当に問うべきなのは、弱い人が誰かではありません。
なぜ人が孤立するのか。
なぜ働いても生活できないのか。
なぜ住まいが失われるのか。
なぜ若い世代が結婚や子育てをあきらめるのか。
なぜ地域の中で助けを求めにくいのか。
生活困窮者自立支援制度、住宅支援、就労支援、家計改善支援、健康管理支援は、生活保護に至る前の支えとして重要です。けれど、それらは「支援」にもなれば「管理」にもなります。
就労支援が、本人の回復を待たずに働かせる圧力になる。
家計管理が、生活の監視になる。
健康管理が、自己責任の説教になる。
困窮支援が、生活保護に行かせないための水際になる。
本当に必要なのは、人を制度に従わせることではありません。
人がもう一度、自分の生活を語れるようにすることです。
佐藤幸治の憲法論で言えば、憲法の中心には「人格的自律」があります。人は、国家や行政に管理されるだけの存在ではありません。自分の人生を考え、語り、選び、他者と関係を結ぶ主体です。
立憲主義とは、単に国家権力を制限することではありません。困窮者、公害被害者、若者、高齢者、外国人、働けない人、働いても貧しい人を、排除や管理の対象にせず、対話の相手として迎えることです。
地域に必要なのは、この対話です。
税を払う人と、支援を受ける人の対話。
行政と住民の対話。
若者と高齢者の対話。
働く人と働けない人の対話。
企業と地域の対話。
公害の記憶と未来の環境政策の対話。
経済成長と文化成熟の対話。
日本は、工業化には成功しました。けれど、脱工業化の後に、地域、福祉、芸術、教育、環境、ケアを中心にした文化成熟社会を十分に育てきれませんでした。その失敗が、地方の空洞化、非正規雇用、少子化、孤立、ひきこもり、生活困窮として現れています。
これからの地域づくりは、単に「にぎわい」を作ることではありません。
誰も寒さや飢えで死なない地域。
住まいを失っても相談できる地域。
子どもの教育をあきらめなくてよい地域。
車が必要な人に、移動の権利を認める地域。
働けない時期があっても、再び社会とつながれる地域。
外国人や少数者を敵にしない地域。
税と福祉と環境と文化を、別々にしない地域。
憲法25条は、遠い条文ではありません。
それは、私たちの町の道路、病院、学校、福祉窓口、商店街、住宅、バス、海、川、職場、家庭の中にあります。
生活保障とは、貧しい人にお金を渡すだけではありません。
生活保障とは、人間が地域の中で、壊されず、孤立せず、もう一度未来を語れる条件を守ることです。
そして地域の成熟とは、強い人だけが生き残る社会ではなく、弱った人の声を聞き、制度を直し、共に暮らす力を育てることです。

# Thinking About Local Life Through Article 25 of the Japanese Constitution
## Welfare, Pollution, Taxation, Declining Birthrate, and Dialogue Over the Past 40 Years
For a long time, Japan saw itself as a wealthy nation.
After the postwar recovery, Japan became the world’s second-largest economy. During the bubble economy, land prices, stock prices, corporations, and urban development expanded dramatically. But that prosperity did not last forever.
The collapse of the bubble economy, the end of the Soviet Union, intensified market competition, the employment ice age, the Lehman Shock, population decline, the falling birthrate, hikikomori, social isolation, lonely deaths, and starvation cases all revealed one painful truth:
**Economic growth alone cannot protect human life.**
At the center of this history stands Article 25 of the Constitution of Japan.
Article 25 promises that all people shall have the right to maintain the minimum standards of wholesome and cultured living. The Public Assistance Act exists to make that constitutional promise real in daily life.
Yet public assistance has often been surrounded by misunderstanding and prejudice. A system meant to save lives has sometimes been discussed through words such as “self-responsibility,” “fraud,” or “you should be able to work.” As a result, people in need may hesitate before reaching the welfare office.
Some people have died of hunger or isolation even though the Constitution and the Public Assistance Act existed. These tragedies show that a system does not save lives merely by existing. It must actually reach people.
Court cases have gradually expanded the meaning of public assistance.
The school expense insurance case showed that even families receiving public assistance may prepare for their children’s education and future. Automobile ownership cases raised the question of whether a car, especially in rural areas, is truly a luxury or an essential tool for hospital visits, shopping, work, and family life. Lawsuits over reductions in public assistance standards questioned whether the government’s calculation of the minimum standard of living had a rational basis.
These cases show that public assistance recipients are not merely people to be managed. They are persons who think about their children’s future, move through their communities, seek medical care, look for work, and try to rebuild their lives.
This perspective also connects with Japan’s history of pollution.
Minamata disease was not merely an environmental accident. It was a case in which economic growth damaged nature, bodies, families, and local communities. Japan moved from pollution control to environmental policy, but lost health and broken trust cannot easily be restored.
Pollution is not outside the economy. It is the result of shifting the hidden costs of growth onto residents, communities, and future generations.
That is why we must think about the economy and public finance more deeply. It is not enough to say, “increase revenue” or “cut spending.”
We must consider the balance between consumption tax and corporate tax, international competition, social security finance, local economies, welfare, and the environment. Consumption tax asks everyone to contribute, but it tends to weigh more heavily on low-income people. On the other hand, if corporate taxation is continuously reduced in the name of international competition, the financial foundation of welfare and local communities becomes weaker.
When people’s lives become insecure, society often looks for someone to blame. Foreign residents, welfare recipients, people with disabilities, the elderly, single parents, and minorities may become targets. This is how racism and exclusionary politics rise.
But the real questions are different.
Why are people isolated?
Why can some people not survive even while working?
Why do people lose housing?
Why do younger generations give up on marriage and raising children?
Why is it so difficult to ask for help in the community?
Support for people in poverty, housing assistance, employment support, household finance counseling, and health management support are all important. But each of these can become either support or control.
Employment support can become pressure to work before a person has recovered.
Household finance support can become surveillance of daily life.
Health management can become moral preaching about self-responsibility.
Poverty support can become a way to keep people away from public assistance.
What is truly needed is not to force people to obey systems.
What is needed is to help people speak about their own lives again.
In constitutional scholar Koji Sato’s theory, the core of constitutional law is personal autonomy. Human beings are not merely objects of state or administrative control. They are subjects who think, speak, choose, and form relationships with others.
Constitutionalism is not only about limiting state power. It is also about welcoming people in poverty, pollution victims, young people, older people, foreign residents, people unable to work, and working poor people as partners in dialogue, not as objects of exclusion or control.
What local communities need is this dialogue.
Dialogue between taxpayers and people receiving support.
Dialogue between government and residents.
Dialogue between young and old.
Dialogue between workers and those unable to work.
Dialogue between businesses and communities.
Dialogue between the memory of pollution and future environmental policy.
Dialogue between economic growth and cultural maturity.
Japan succeeded in industrialization. But after industrialization, it did not fully develop a mature society centered on community, welfare, art, education, environment, and care. This failure appears today as regional decline, unstable employment, falling birthrates, isolation, hikikomori, and poverty.
Local revitalization must not mean simply creating “liveliness.”
It must mean building communities where no one dies from cold or hunger; where people can seek help when they lose housing; where children’s education is not abandoned; where mobility is recognized as part of life; where people can reconnect with society after periods of illness or unemployment; where foreigners and minorities are not turned into enemies; and where tax, welfare, environment, and culture are not separated.
Article 25 is not a distant legal text.
It exists in our roads, hospitals, schools, welfare offices, shopping streets, homes, buses, rivers, seas, workplaces, and families.
Social security is not only about giving money to the poor.
It is about protecting the conditions that allow human beings to live in their communities without being broken, isolated, or deprived of the ability to imagine a future.
A mature community is not one where only the strong survive.
It is one that listens to weakened voices, repairs institutions, and learns how to live together.

长期以来,日本一直认为自己是一个富裕的国家。

健康管理可能变成关于自我责任的说教。
困窮支援可能变成阻止进入生活保护的“水际作战”。
真正需要的,不是让人服从制度。
真正需要的,是让人重新能够讲述自己的生活。
从宪法学者佐藤幸治的理论来看,宪法的核心是“人格的自律”。人不是国家和行政单方面管理的对象。人是能够思考、表达、选择,并与他人建立关系的主体。

今后的地方建设,不应只是制造“热闹”。
它应当是这样的地域:
没有人因寒冷或饥饿而死。
失去住房时可以求助。
孩子的教育不必被放弃。
需要移动的人能够被承认有移动的权利。
即使经历失业或疾病,也能重新与社会连接。
外国人和少数者不会被当作敌人。
税、福利、环境和文化不会被彼此切割。
宪法第25条并不是遥远的法律条文。
它存在于我们的道路、医院、学校、福利窗口、商店街、住宅、公交车、河流、海洋、职场和家庭之中。
生活保障,不只是给贫困者金钱。
